GENERAL TERMS AND CONDITIONS OF SALE
1 – Preamble
The Merchant site artmontessori.com is operated by the Société Art-Montessori with a capital of €2000, having its registered office at 08, rue des Bordes – 77580 Crécy-la-Chapelle - France and registered in the commercial and companies register of Meaux under the number RCS 829 781 046.
The following general terms and conditions of sale apply to all orders placed with the company Art-Montessori for all the articles proposed on the site artmontessori.com, except prior other written agreement .
The terms of sale applicable to any transaction on the site art-montessori.com are those mentioned online on the site at the time of the ordering by the customer. The customer acknowledges having read these conditions prior to his order.
As a result, ordering on the art-montessori.com website implies full acceptance of these Terms of Sale by the customer.
2-Prizes
2-1 – Prices are expressed in euros including all taxes excluding participation in processing and shipping costs.
2-2 – In the case of an order to an other country than metropolitan France, the purchaser is the importer of the product (s). For all products shipped outside the European Union and DOM-TOM, customs duties, other local taxes, import duties or state taxes are liable to be payable. These rights and sums are not within the purview of the Art-Montessori society. They will be at the expense of the purchaser and are in full responsibility both in terms of declarations and payments to the competent authorities of the concerned country.
2-3 – All orders are payable in.
2-4 – Art-Montessori reserves the right to modify its prices at any time on its website art-montessori.com. The products are charged on the basis of the tariffs in force at the time of the registration of the orders subject to availability. The products remain the property of Art-Montessori until the complete payment of the sale price.
3-Order and Validation
3-1-The client of the Art Montessori company must be a minor emancipated or have a legal majority and not be protected within the meaning of article 488 of the Civil Code. The company Art-Montessori reserves the right to refuse an order if the customer presents a default payment in its order history.
3-2-These terms and conditions are available on the artmontessori.com website. At the request of the customer, these can be sent by e-mail or by mail.
3-3-When the customer clicks the "Validate" button after the order process, he declares to accept this and all of the present general Conditions of Sale fully and without reservation. The data recorded by Art-Montessori are proof of all transactions passed by Art-Montessori and its customers. The data recorded by the payment system is the proof of the financial transactions.
3-4 – The customer is responsible for the accuracy and completeness of the information provided by himself on his customer account and on his order to ensure his good treatment. The Art-Montessori company will not be liable for additional delivery times or costs. The costs incurred by the Art-Montessori company due to errors on the information provided by the customer will be borne by the customer.
4-Availability
Our product offerings are given within the limit of available stocks. In this context, information on the availability of the products is provided to the customer at the time of the order. If the items prove unavailable after the order, the company Art-Montessori will inform and invite the customer to cancel or modify its order
5-Delivery
Art-Montessori delivers its products in France and in all the countries of the European Union and can on request deliver in any country.
The products are shipped, with delivery voucher, to the delivery address indicated by the customer when ordering. Delivery cannot be carried out in hotels or post office boxes. The delivery times indicated on the site are indicative, corresponding to the average processing and delivery times. In order for these deadlines to be respected, the customer must ensure that they have communicated accurate and complete information concerning the delivery address (such as: Street, building, stair, access codes, names and/or intercom numbers, etc.).
In case of a delivery delay of more than 7 working days, if the product has not been shipped, the customer may denounce the order by registered letter with notice of receipt and request the reimbursement of his order.
If the item was shipped before the cancellation of the order for delivery delay of more than 7 days, Art-Montessori will reimburse the item and the shipping and return costs, upon receipt of it, complete, in its condition of origin.
Art-Montessori is committed to inform the customer about the evolution of the processing of his order.
In case of damaged parcels (opened, missing products...), the customer agrees to notify to the carrier and to Art-Montessori, by all means, any reservations within 3 days after receipt of the product.
Art-Montessori will not be held responsible for the consequences due to a delay in routing that is not his doing.
6-Payment
6-1 – For individuals and non-professionals, theproducts are payable in full to the order. Payment is made by credit card (Visa, MasterCard, national and international Blue Card, American Express, etc...)
The Art-Montessori company implements all the necessary means to ensure the security and confidentiality of the data transmitted online.
6-2 – Orders for early childhood professionals are subject to a quotation sent to the customer by mail accompanied by the bank details of Art-Montessori. The "Voucher for agreement" of the quotation is accompanied by the payment of 50% by bank transfer. The balance is to be paid on invoice within a maximum period of 30 days after delivery.
6-3 – Orders from municipalities and local authorities are subject to a quotation sent to the customer by mail. This quotation must be signed by a person appointed with the word "agree for the payment of .....€ ." »
The payment is made on invoice after full delivery by mandate of the public treasury or the municipal cash.
In case of delivery or shipping, packing and port fees are to be added.
7-Return and SAV policy
7-1 – According to articles L 121-16 of the consumer code, the customer has a reflection period of 14 days from the delivery to return the item (or) the items ordered without having to pay penalties except for the costs of return that will remain at his charge. The items must be returned in their original packaging, complete and undammaged.

Items returned incomplete or damaged by the customer will not be reimbursed.
The risks and costs of return are always the responsibility of the customer.
We invite the customer to return the parcel by any means bringing the proof and giving certain date to its shipment (recommended with receipt notice, Colissimo follow-up, etc.).
7-2 – If the return is due to an error of Art-Montessori, the cost of delivery and return which has been paid by the customer will be reimbursed. For this the customer must enclose in his return parcel a proof of transport costs to be able to be reimbursed.
Once the products are received, checked, and accepted by our services, the reimbursement of the returned items will be made at the invoice price by credit on the bank account of the client corresponding to the credit card which was used for payment at the latest in 14 days after receiving the returned items.

7-3 – Return policy outside Metropolitan France.
The costs of return and exchange are at the expense of the customer outside France. Non-EEC, customs duties, taxes and formalities are the responsibility of the customer.

8-Intellectual Property
All elements of the site artmontessori.com whether they are visual, graphic, video or sound, are protected by copyright, trademarks or patents. They are the exclusive property of the Art-Montessori company. Consequently, partial or total reproduction, on any medium, of the elements composing the site and the catalogue, their use and their making available to third parties are strictly forbidden.
9-Responsibility
The products proposed are in conformity with the European legislation. The responsibility of Art-Montessori cannot be committed in case of non-compliance with the laws of the country in which the products are delivered. It is up to the customer to check with the local authorities on the possibilities of importing or using the products he intends to order.
The photographs and texts reproduced and illustrating the products presented are not contractual. Consequently, the responsibility of Art-Montessori cannot be committed in the event of an error in one of his photographs or one of his texts.
Art-Montessori cannot be held responsible for the breach of the contract concluded in case of failure of stock or unavailability of the product, force majeure, total or partial strikes, internal or external to the company, blocking of the means of Transportation or supply for any reason whatsoever, government or legal restrictions, computer failures, blocking of telecommunications including networks and particularly the Internet.
Art-Montessori shall not be liable for any consequential damages hereunder, loss of operation, loss of profit, damages or expenses.

10-Protection of personal data
The company Art-Montessori agrees not to divulge to third parties the information communicated on the site artmontessori.com. These are confidential. They can be used to personalize the communication and the offer of products reserved for Art-Montessori customers.

11-Modification of the general conditions of sale
The company Art-Montessori reserves the possibility to adapt or modify at any time the present general conditions of sale. The new general terms of sale will be brought to the attention of the customer by modification on line and will be applicable to the sales made after the change.
12 – Applicable law
The present general conditions of sale are governed by French law. In case of dispute, only the French courts will be competent.
